Terms of Use

1. Acceptance of Terms
By accessing or using the Ijtima mobile application (the "App") or website at ijtima.org(the "Website"), collectively referred to as the "Service", you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not access or use the Service.
These Terms constitute a legally binding agreement between you ("you", "your", or "User") and Ijtima ("we", "us", or "our").
2. Description of the Service
Ijtima is a companion application for the annual gathering, providing:
- Event schedules and programme listings
- Live updates and announcements
- Community features and engagement tools
- Donation and payment processing capabilities
- Push notifications for schedule reminders and event updates
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.
3. Eligibility
You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age, you may only use the Service with the consent and supervision of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements.
4. User Accounts
4.1 Account Creation
Certain features of the Service may require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account or any other breach of security.
4.3 Account Termination
We reserve the right to suspend or terminate your account at our discretion if we reasonably believe you have violated these Terms or engaged in conduct that is harmful to the Service, other users, or our organisation.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable local, national, or international law or regulation.
- Harass, abuse, threaten, or intimidate other users or any individual.
- Post, upload, or transmit content that is defamatory, obscene, hateful, discriminatory, or otherwise objectionable.
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Attempt to gain unauthorised access to any portion of the Service or any other systems or networks.
- Use automated scripts, bots, or scrapers to access the Service or collect data from it.
- Upload or transmit viruses, malware, or any other malicious code.
- Use the Service for any commercial purpose without our prior written consent.
- Collect or store personal data about other users without their express consent.
6. User Content
6.1 Your Content
You retain ownership of any content you submit, post, or display through the Service ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display such content solely for the purpose of operating and improving the Service.
6.2 Content Standards
All User Content must comply with our Community Guidelines. We reserve the right to remove any User Content that violates these Terms or our Community Guidelines without prior notice.
6.3 Reporting
If you encounter content that you believe violates these Terms, please report it to us at support@ijtima.org.
7. Donations and Payments
7.1 Payment Processing
Donations and payments made through the Service are processed by Stripe, a third-party payment processor. By making a payment, you agree to Stripe's terms of service and privacy policy. We do not store your payment card details on our servers.
7.2 Recurring Donations
If you set up a recurring donation plan, payments will be charged according to the schedule you selected. You may cancel or modify your recurring donation at any time by contacting us at support@ijtima.org.
7.3 Refunds
Donations are generally non-refundable. If you believe a payment was made in error, please contact us within 14 days of the transaction at support@ijtima.org and we will review your request on a case-by-case basis.
7.4 Gift Aid
If you are a UK taxpayer and opt in to Gift Aid, you confirm that you have paid or will pay an amount of Income Tax and/or Capital Gains Tax for each tax year that is at least equal to the amount of tax that all the charities and Community Amateur Sports Clubs you donate to will reclaim on your gifts for that tax year. We will retain Gift Aid declarations in accordance with HMRC requirements.
8. Intellectual Property
8.1 Our Content
The Service and its original content (excluding User Content), features, and functionality are owned by Ijtima and are protected by copyright, trademark, and other intellectual property laws. Our trademarks, service marks, and logos may not be used in connection with any product or service without our prior written consent.
8.2 Licence to Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial use. This licence does not include the right to modify, distribute, or create derivative works from the Service.
9. Third-Party Services and Links
The Service may contain links to third-party websites, services, or resources. We are not responsible for the availability, content, or practices of these third-party services. Your use of third-party services is at your own risk and subject to their respective terms and policies.
10. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free.
- The information provided through the Service (including event schedules and programme details) will be accurate or reliable.
- Any defects in the Service will be corrected.
Event schedules, programme details, and other information displayed in the Service are subject to change without notice. Always verify critical information with event organisers directly.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Ijtima and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total aggregate liability for any claims arising out of or relating to the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or fifty pounds sterling (£50), whichever is greater.
12. Indemnification
You agree to indemnify, defend, and hold harmless Ijtima and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we may also notify you through the App or by email.
Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, and End User Licence Agreement, constitute the entire agreement between you and Ijtima regarding your use of the Service.
